Ohio Drunk Driving Penalties (OVI-DUI Penalties) According to the Ohio department of Public Safety and Ohio drunk driving laws, a drunk driving conviction (OVI-DUI conviction) can have the following consequences: Administrative License Suspension (ALS) Hearings (in addition to any criminal charges): * NOTE: You have 5 days to request a hearing * Refusal to submit to a sobriety test - 1 to 5 years license suspension * 1 year for first refusal * 2 years if one previous conviction * 3 years if two previous convictions * 5 years with three or more previous convictions * Blood Alcohol Content (BAC) above legal limit - 90 days to 3 years license suspension First Drunk Driving (OVI-DUI) Conviction: * Jail - 3 days or a 3-day driver intervention program * Fine - mandatory $200 up to $1000 * Court Ordered Drivers License Suspension - 6 months up to 3 years Second Drunk Driving (OVI-DUI) Conviction: * Jail - minimum 10 days or 5 days + 18 days house arrest up to 6 months * Fine - mandatory $300 up to $1500 * Court Ordered Drivers License Suspension - 1 year up to 5 years * Discretionary driver's intervention program * Vehicle immobilization and plates impounded for 90 days Third Drunk Driving (OVI-DUI) Conviction: * Jail - minimum 30 days or 15 days + 55 days house arrest up to 3 years * Fine - mandatory $300 up to $1500 * Court Ordered Drivers License Suspension - 1 year up to 10 years * Mandatory drug-alcohol treatment program; paid by offender * Vehicle immobilization and plates impounded for 180 days * Vehicle Forfeiture - if 3rd offense within 3 years Fourth, or More, Drunk Driving (OVI-DUI) Conviction or Motor Vehicle Related Felony: * Jail - minimum 60 days up to 1 year * Fine - mandatory $750 up to $10,000 * Court Ordered Drivers License Suspension - 3 year up to permanent revocation * Mandatory drug-alcohol treatment program; paid by offender * Vehicle immobilization and plates impounded for 180 days * Vehicle Forfeiture - mandatory forfeiture of vehicle operated by offender
