You have a right to have the automatic suspension of your DriverŐs License reviewed by a DMV hearing officer. You can also petition the DMV for a hardship license and for other special allowances. Time Limit for Driver's License Review To get a DMV hearing to review the suspension of your DriverŐs License based on a DUI arrest, it must be requested within 10 days of your arrest or the right is waived. If you do request a DMV DL hearing within those 10 days, the suspension of your DriverŐs License is delayed for another 45 days pending that hearing. While Public Defenders do a good job, they have high caseloads and may not be able to provide you with the individual attention you would receive if you retain a private attorney. A Public Defender only represents you for the criminal charge, Public Defenders do not attend or request DMV hearings. If you are represented by the Public Defender, you may unknowingly waive your rights with the DMV.
