Christopher Peter DiGiulio was arrested last month and arraigned Tuesday for investigation of driving under the influence of intoxicants and for refusing to take a breath test for alcohol, The Bend Bulletin reported.
Both charges are misdemeanors.
A related search warrant affidavit says DiGiulio admitted to the arresting officer that he smoked marijuana earlier in the day.
DiGiulio’s attorney, Bryan M. Donahue, says a decision on opting for alcohol diversion treatment remains open.
His next court date is scheduled for Feb. 16.
